Craig McKee is an attorney registered as a civil mediator by the Indiana Supreme Court. Mediation includes convening parties to explore settling disputes without resort to time-consuming and expensive trials. During mediation, a neutral and impartial third party acts to encourage and facilitate the resolution of a dispute without prescribing what it should be. It is an informal and non-adversarial process intended to help disputing parties reach a mutually acceptable agreement.

Our attorneys have also participated as arbitrators in disputes where alternative dispute resolution was mandated by various contracts or by agreements of the parties.

Pre-suit Mediation

Court-ordered mediation typically occurs after suit is filed. Pre-suit mediation occurs without order of the court and before suit is filed. Many personal injury victims are surprised to learn that they may settle their claims without needing to file a lawsuit. Early settlement may occur when there is little or no question as to liability such as in cases where the other driver has admitted responsibility or when the injured parties are severely injured.   Either the insurer or the injured party may propose a pre-suit mediation in an effort to get the matter resolved without the necessity  of filing a lawsuit.  Mediation allows both sides to  confidentially discuss the case with an independent third party mediator who will work to help the parties reach a settlement.

Our firm’s registered mediator has experience with the laws and issues that are important to most cases. If no settlement is reached at mediation, the case can still proceed to litigation. Failure to settle a case should not affect the personal injury victim’s right to file a lawsuit.
